Lawsuit resolved over injuries to Wichita police officer

Attorneys have announced that a pending lawsuit has been resolved over injuries to Wichita police officer Brian Arterburn in 2017.

Arterburn and his wife, Claudale, filed a lawsuit seeking punitive damages against Eddy’s Chevrolet Cadillac with regard to a stolen SUV, and the lawsuit had been scheduled for trial this year.   Attorneys said Tuesday the case has been resolved, and the terms are confidential.   Their statement said no further public comment will be made.

Arterburn was severely injured in February, 2017 during a chase with the SUV in a south Wichita neighborhood.  Arterburn went through months of rehabilitation at out-of-state facilities and later was given medical retirement from the Wichita Police Department.

The driver of the SUV, Justin Terrazas, pleaded guilty in 2018 and was sentenced to over 39 years in prison.

The lawsuit said the SUV, a 2016 Chevy Tahoe, had been stolen from Eddy’s Chevrolet Cadillac, but that was not reported to police until February of 2017, almost two months after the theft.   The lawsuit claimed that Eddy’s failed to secure its inventory and failed to establish safeguards to prevent vehicle thefts.    According to the lawsuit, the dealership claimed it has no understanding of how Terrazas came to be in possession of the SUV.
